Competition Terms and Conditions
Entry into the Design & Win with Willow Creek Olive Estate (“Competition”) is deemed acceptance of these Terms and Conditions. Instructions on ‘How to Enter’ and prize information also form part of these Terms and Conditions.
For the purpose of these Terms and Conditions, the promoter is Willow Creek Olive Estate of Nuy Road Nuy Valley, Worcester, Western Cape (“Promoter”).
The Competition is open to South African residents aged 18 years or older only (“Entrant”). Entry is not open to directors, management, officers, employees and contractors of the Promoter, their associated agencies and companies, and their immediate families. For the purposes of this paragraph, “immediate families” of an employee includes his or her spouse, ex-spouse, de facto spouse, child, step child, adopted child, parent, step-parent, grandparent, uncle, aunt, siblings, step-siblings, or first cousin, whether or not they live in the same household as the director, manager, officer, employee or contractor.
The Competition commences at 20:00 SAST on Tuesday 26 July 2022.
Entries close on 4 September 2022 at 24:00 SAST. (“Competition Period”).
Entries received outside of the Competition Period will not be accepted by the Promoter and will be deemed to be invalid. The time of entry will be deemed to be the time the entry is received by the Promoter and not the time of transmission by the Entrant. This Competition is a game of skill and creativity, chance plays no part in determining the winner.
How to Enter
Entrants may either make a submission individually or as a team, specific to the competition. Competition entrants are prohibited from sale, assignment or transfer of any of their submission rights to a third party. Once the final submissions are sent, no additional changes, or edits can be made.
To enter the Competition, the Entrant must submit to the Promoter a completed entry application, available at https://willowcreek.co.za/. This application will require the Entrant to provide, amongst other things:
- A digital design for the Willow Creek Olive Oil Gift range packaging;
- Supporting files and comments on materials, colours, etc.;
- The Entrant may enter as many times as they like throughout the Competition Period provided that each entry is unique and original.
- To enter the Competition, Entrants must follow the entry instructions and comply with all other applicable requirements during the Competition Period. Entries must be submitted in accordance with the entry instructions and will not be accepted in any other form.
- An Entrant’s Entry must not be late, incomplete or incomprehensible or contain any content that infringes the rights (including intellectual property rights) of any person or is unlawful, obscene, offensive, indecent, defamatory, discriminatory, libellous, threatening, pornographic, harassing, hateful, racially or ethically offensive or otherwise objectionable or inappropriate (which includes, without limitation, any content involving excessive violence, malice or swearing), capable of encouraging conduct that would be considered a criminal offence, capable of violating any law or giving rise to any civil liability.
- Once submitted, no changes to or withdrawal of an Entry will be permitted.
Selection of Winners & Prizes
Of all the Entries submitted, one will be selected (the “Shortlist”) to win the prize. There is only one prize available in this Competition: R20 000 prize money, and the honour of having your design printed into the product packaging..
The Prize will be awarded by the Promoter following a judging of all valid Entries received within the Competition Period by a panel of judges appointed by the Promoter and located at the Promoter’s head office. The Entrant who submits the Entry which is judged as most actively representing Willow Creek’s style will win the competition.
The Promoter’s decision in relation to any or all aspects of this Competition is at its complete discretion, final and binding on all persons who enter into this Competition and no correspondence will be entered into.
The Promoter will put the Willow Creek Prize Winner’s Entry (or a modified version thereof, as determined solely by the Promoter) into commercial production (in such volumes and using such production materials and methods as determined by the Promoter in its sole discretion).
The Entrant agrees to take any steps necessary to assign all of the Entrant’s rights, title and interest in the intellectual property of the winning Entry to the Promoter. The Entrant accepts that it will not be entitled to proceeds from the commercial sale of the Willow Creek products under any circumstances.
The Prize Winner may be interviewed to be featured in the Promoter’s blog or on other of the Promoter’s digital and social media channels. The Winner must participate in the Prize personally.
Privacy
By entering the competition, the entrant acknowledges and accepts that all aspects of any submission narrative, description, details, images, illustration and animation may be used for publicity purposes by Willow Creek Olive Estate.
The Promoter will collect Entrants’ personal information in order to conduct the Competition and also in order to conduct advertisements, publications, media statements and other promotional material associated with the Competition. If the information requested is not provided, the Entrant may not participate in the Competition.
The collection, use and disclosure of personal information provided in connection with this Competition is governed by the Promoter’s privacy policy, available at /help/privacy. Entrants consent to the Promoter using the Entrant’s name, likeness, image and/or voice in the event that they are a Winner (including photograph, film, file and/or recording of the same) in any media for an unlimited period of time without remuneration for the purpose of promoting this Competition (including any outcome) and promoting any goods or services provided by the Promoter.
By entering the Competition, the Entrant consents to receipt of any email regarding the Competition and other emails or communications which inform the Entrant of the Promoter’s other publications, products, services and events and to promote third party goods and services in which the Promoter considers the Entrant may be interested.
Competition Disqualification
Willow Creek Olive Estate holds the right to disqualify any submission which is non-compliant to the competition guidelines, do not meet the rules and regulations or is found to contain any identifying sign or mark that can contribute to the identity of the entrant. All submissions after the closing date for a particular competition shall be automatically disqualified. Willow Creek Olive Estate shall be under no obligation to notify the entrant or participant of the disqualified entry or submission.
Competition Cancellation / Withdrawal
The right to cancel or suspend or alter the rules of the competition at any point in time is held by Willow Creek Olive Estate, if deemed necessary in its opinion and if circumstances arise outside its control.
Ownership and Copyright
No entrants or participants shall receive or be entitled to receive any payment in any form for submission or for granting Willow Creek Olive Estate any right herein, other than for being selected as one of the winning entries of the competition.
Plagiarism
If charges of plagiarism are made against an entrant or participant, the charges are to be addressed at the earliest by the accused entrant or participant. Willow Creek Olive Estate holds the right to take down the content from all its channels until the matter is resolved.
License
By submitting your entry to the competition, you the “entrant” provide Willow Creek Olive Estate with a limited, exclusive, sub-licensable, worldwide, royalty-free license, whose license is effective till perpetuity, to use, copy, modify, translate, and/or adapt, distribute, publicly display by any means and in any media and create derivative works of your entry solely in connection with the inclusion of your entry in activities related to, and the promotion of, the competition and the particular project, without any further notice or remuneration to you.
These rights shall be applied to all existing or future media, and in particular all physical, optical, magnetic, analogical, digital and electronic media, including media such as hardcopies, cd-roms, dvd-roms, hard disks, computers and servers, the internet, all private or public telecommunication networks, by cable, satellite, radio networks, etc.
By submitting your entry to the competition you also give Willow Creek Olive Estate an exclusive, worldwide, royalty-free, irrevocable license in perpetuity, to display and archive your entry on Willow Creek Olive Estate’s website, www.willowcreek.co.za (“website”), on Willow Creek Olive Estate’s Facebook, Instagram, twitter or any other social networking / media pages in relation to the competition. Any credits will be with the name you supply for the competition.
Our Collected Information
The information we collect are either from you directly or through the cookies that your browser stores in your computer. These cookies do not allow us access to your personal computer, neither do they store any personal or payment details. The personal information collected is mainly used for competition submission administration and processing (according to the competition terms and conditions). We may sometimes also monitor site usage and traffic patterns to improve our site functioning and services. We may also use your details to keep you informed of future competitions or promotions.
Security Policy
Willow Creek Olive Estate is aware of your safety and security, for which all sensitive information are collected and processed through a secured system. Whenever you are required to provide with any sensitive information like your payment card details, you will be taken to a secure system.
General Indemnity
You agree to indemnify Willow Creek Olive Estate fully from and against all claims, liability, damages, losses, costs and expenses, legal fees arising out of any breach of these conditions by you or any other liability arising out of your use of the site.
Liability
The entrant agrees to release, indemnify, defend any party from any liability, any claim for damages, and/or lawsuit for or by reason of the mentioned submission as a result of any submission, revision, alteration or similar thereof. The entrant also acknowledges and agrees and therefore covenants not to sue or make any claim against any party related to an entrant’s submission or any individual participation or involvement in the competition in any way whatsoever, or any use thereof.
Under no circumstances shall or can the entrant be entitled to any loss or damage, which include attorney’s fees. Any dispute, claim and legal action arising from or connected with this competition, or any prizes awarded or potentially awarded therein, shall be resolved without resort to any form of legal action or class action. Should an entrant choose to bring a claim against Willow Creek Olive Estate or its agents the entrant shall pay Willow Creek Olive Estate or any party’s reasonable attorney fees and its legal costs arising from the claim, should it fail. Nothing herein will constitute a waiver of the entrant’s or participant’s legal rights or any rights any party may have to take against the entrant or the participant.
Willow Creek Olive Estate will not be responsible or liable for any lawsuit or claim against any of its judges or selector panel, emanating from their professional conduct or otherwise.
Unless clearly stated, all competitions are design concept only and do not imply in any way, an intention for the proposals to be physically constructed or built.
Amendments
Willow Creek Olive Estate reserves the right to amend these terms and conditions at any time without notice. The responsibility is yours to check the website regularly if we have made any changes to these terms and conditions.
